DWP have issued guidance on replacing support with mortgage interest with loan payments from 6 April 2018 - amendments to Loans for Mortgage Interest Regulations 2017 and Loans for Mortgage Interest and Social Fund Maternity Grant (Amendment) Regulations 2018:
The below memos provide guidance to decision makers on the new rules which mean that owner occupier loan payments are no longer part of the claimant’s benefit award*. The guidance outlines the process for offering and accepting the loan, it’s calculation, repayment, liability questions, qualifying periods and rules on occupying accommodation; explains how the transitional rules, which identify the end date of support with mortgage interest payments, will operate; confirm a disregard of specified mortgage protection payments** and outline associated amendments to social fund rules to ensure that entitlement to loan payments can, in specified circumstance, count as a ‘qualifying benefit’. There is also detailed guidance on the process for continuing support for mortgage interest payments for a longer period for claimants who lack capacity to accept a loan.
