Benefit cap deemed unlawful for lone parents with children under 2

Following a judicial review in DA and Others v Secretary of State, the High Court has ruled that the benefit cap legislation is unlawful in relation to its application to lone parents under the age of 2.
The DWP has issued guidance to decision makers and will appeal the decision. Those with children under 2 affected by the legislation will continue to be subject to the cap until the outcome of the appeal.
